Obama Reiterates Support For Finishing ACTA

President Obama Thursday reiterated his administration's commitment to enacting the Anti-Counterfeiting Trade Agreement, aimed at curbing global piracy, despite a vote by the European Parliament this week calling for greater transparency in the deal's negotiations.

During remarks at the Export-Import Bank's annual conference, the president discussed the need to "aggressively protect" U.S. intellectual property.

"There's nothing wrong with other people using our technologies, we welcome it -- we just want to make sure that it's licensed, and that American businesses are getting paid appropriately," Obama said. "That's why [the Office of the U.S. Trade Representative] is using the full arsenal of tools available to crack down on practices that blatantly harm our businesses, and that includes negotiating proper protections and enforcing our existing agreements, and moving forward on new agreements, including the proposed Anti-Counterfeiting Trade Agreement."

Mark Esper, executive vice president of the U.S. Chamber of Commerce's Global IP Center, applauded the president for highlighting the importance of IP protection "as well as singling out the need for a strong Anti-Counterfeiting and Trade Agreement that will raise the bar on enforcement standards and improve cooperation between nearly forty countries."

The copyright clause of the constitution reads "To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." Whilst many of us would support moves to protect against counterfeit goods such as designer cloths and poor quality DVDs etc you have to wonder whether a large proportion of the counterfeiting is not of the governments own making. For instance a few years ago Antigua filed a complaint against the US for ripping up trade agreements as they were operating online poker sites. At the time it was intimated that they were after $100m and if the US were not going to play ball then an option that was for Antigua to sell up to $100m of counterfeit US gear to recoup the damages eg Microsft Windows etc.

National Oceanic and Atmospheric Administration chief Jane Lubchenco told a House panel yesterday that her agency had no plans to halt fishing. And National Marine Fisheries Service chief Eric Schwaab released a statement last night saying NOAA "is committed to adopting policies that will ensure that current and future generations have the opportunity to enjoy the great tradition of recreational fishing."

The rumors apparently started with an online column Tuesday on ESPN's outdoors Web site, which said the administration's new oceans policy could prohibit fishing in oceans, Great Lakes and inland waters. Robert Montgomery's column questioned whether environmental groups have had undue influence on the plan.

The news blog Drudge Report reposted the column, and dozens of right-wing bloggers wrote yesterday that President Obama would ban recreational fishing.

For instance, Gateway Pundit blogger Jim Hoft wrote: "Obama's Latest Assault on Freedom -- New regulations Will Ban Sport Fishing." He quoted from the ESPN column, adding, "Barack Obama has a message for America's 60,000,000 anglers -- We don't need you."

Fox Nation also featured this headline yesterday: "Obama to ban sport fishing?" with links to Hoft and ESPN.

The administration is drafting plans for a new ocean policy and marine planning system. The inter-agency ocean task force has released draft plans that would set ocean conservation as a top national priority and lay the groundwork for marine planning. The group is working on final recommendations. The plan could eventually lead to efforts to map the sea for different uses, but draft reports from the group made no suggestions to ban fishing.

A spokeswoman for the White House Council on Environmental Quality, which is leading the effort, said the task force's plans have involved input from the recreational fishing community and conservationists.

"These draft reports are not map-drawing exercises, they do not contain a zoning plan, and they do not establish any restrictions on recreational fishing or on public access, nor make any judgments about whether one ocean activity or use is better than another," said CEQ spokeswoman Christine Glunz.

But with rumors flying yesterday, Reps. Paul Broun (R-Ga.) and Kathy Dahlkemper (D-Pa.) both expressed concern about the issue in a House Science Committee hearing. They asked the NOAA chief if the administration is considering a ban on recreational fishing.

"Will you please reassure me and the angling public, whether commercial or recreational that their issues are going to be taken into consideration?" Broun asked.

"Both commercial and recreational fishing are vitally important to this nation," Lubchenco said. "We are not proposing any blanket ban on recreational fishing. I would strongly oppose that, and it is not in the works."

Thousands from the fishing industry gathered outside the Capitol last month to protest strict new reductions in their catch that stemmed from mandates to end overfishing and rebuild fisheries that were part of massive fisheries legislation Congress passed in 2006. Fishers took to a stage to question whether NOAA listened more to environmentalists than fishers and chanted "Jane's gotta go!" (E&ENews PM, Feb. 24).

ESPN outdoors editor Steve Bowman issued an apology yesterday afternoon, saying the article should have been clearly identified as commentary, not news, and should have had more balance. The Web site has since altered the article and added a header identifying it as an opinion piece.

As an example, I have no objection against letting one vendor obtain an exclusive trademark for his products and prohibit competitors from selling low-grade stuff under the same name, but that is already dealt with under existing laws. When I learn from ACTA leaks that trademark owners also want customs to search the personal property of individual tourists for counterfeit items even as they are not meant for sale, my reaction certainly won't be to avoid buying counterfeits, but to avoid trademarked stuff altogether. And I hardly even travel abroad myself; I'd still boycott the stuff in support of those who may suffer from such treatment! Trademarks should primarily benefit the consumer, not the producer, and punishing consumers for disregarding that benefit won't go down well with the general public.

Then I hear some businesses even want to search my laptop and my mobile phone for unauthorized music? This isn't going to be in the final agreement if there ever will be one; the European Parliament has already declared it will veto any deal going beyond the initial target of ACTA, counterfeiting and trademark infringement. That still makes me want to shun any corporation that has had a part in this, merely because they allowed those proposals to be made. I can understand they want to keep secret exactly who made what proposal, but that doesn't help - unless they reject ACTA altogether, I won't do business with them. Then who will remain to benefit from the agreement?

that is what ACTA is all about, garning cooperation from the ISPs, this was their tactic all along. notice how much steam ACTA got right after the RIAA announced that they had ALL IPSs on board for a new filtering plan, remember that, back in Dec 09?, when that didn’t work, they modeled the language of ACTA around examples of The Great Firewall of China.

After reading through the leaked documents I realized something very interesting. ACTA has secondary liability buried in it. Secondary liability is where a parent is held responsible for their childs actions, or in the case the ISPs are held responsible for the actions of their subscribers. Since the 9/11 attacks, Guantánamo Bay has again been at the forefront of an ongoing rift between the United States and Cuba.

Guantánamo Bay is a military prison in under the control of the U.S. per the 1903 Cuban-American Treaty. Not until today, January 22, 2009, have we managed to make progress with that request.

Today, President Obama issued an Executive Order to close Guantánamo Bay and to prohibit the use of torture by U.S. military personnel.

I think it sends a very clear message that Bush’s ‘War On Terror’ will not continue to give the United States permission to terrorize others behind a very thin veil under our new Administration.

How can you tell other countries what they can and cannot do? I run a custom made shirt company and I see designer clothes that are copied all the time. This really doesnt make much sense to me. This will never work and just be another program that we waste millions of dollars on.

I don't understand the reasoning behind this ACTA thing. I understand that Obama is trying to keep businesses safe from piracy, but in a way he is violating our privacy. I am a cheap auto insurance sales representative and I don't want my privacy on my computer or any of my clients' privacies to be violated either.

While the point about withholding the positions of the parties in an ongoing negotiation is at least partly understandable, how come a FOIA request for those documents is denied on the grounds of national security? Is this a routine classification used for all negotiation rounds with foreign partners, or is it motivated by the sensitive nature of this particular negotiation? Does the White House actually say that the global harmonization of the legal protections offered to the Mickey Mouse character is a national security issue? Seriously?
