The Democratic member of the panel since 2004 will succeed Republican William Kovacic, who led the agency charged with consumer protection and preventing unfair business practices for less than a year. Since he is on the commission, Leibowitz does not require Senate confirmation. He serves alongside Kovacic, Republican J. Thomas Rosch and Pamela Jones Harbour, an independent. He worked for the Motion Picture Association of America and was once Democratic counsel for the Senate Judiciary Antitrust Subcommittee. Obama needs to fill another vacancy on the five-member panel.
